At least one person has been killed in Senegal's capital after police fired tear gas at hundreds of demonstrators, gathered to protest a court ruling allowing the nation's elderly leader to run for another term.
The man was run over by the police's armoured-personnel carrier, according to Private radio station RFM. An Associated Press reporter saw the young man fall to the ground after the tank-like truck forced its way through the knot of protesters.
Police launched the assault after demonstrators began chanting, "Palace! Palace!" indicating that they planned to march on the presidential palace.
The demonstrators are protesting a ruling by the country's top legal body, the constitutional council, which validated President Abdoulaye Wade's bid to run for another term in next month's election. The 85-year-old President Wade is seeking a third term, even though the constitution was revised soon after he was elected in 2000 to impose a two-term limit. Mr Wade argues that the law is not retroactive, and since he was already in office when it took effect, it should not apply to him.
Clouds of tear gas hung over the Colobane, Fass and HLM neighborhoods of the capital. Burning tires could be seen at regular intervals, as well as overturned market tables. Besides the death of the young man, AP reporters saw four injured civilians, who were taken away on stretchers by emergency responders.
Senegal has historically been the most peaceful nation in West Africa, a region that has been periodically rocked by military coups. By contrast in Senegal, the roots of democracy run deep, and since independence from France in 1960, Senegal has never had a coup d'etat. The 2000 election that brought Mr Wade to power after 25 years in the opposition was held up as a model, because the former leader telephoned Mr Wade to concede defeat - a gesture unheard of in Africa at the time.
RFM radio, owned by the pop star Youssou Ndour, reported the death of the young man, airing an interview with Dr Babacar Niang, head of Suma Assistance, the paramedic company that attempted to resuscitate him. Police chief Harona Sy confirmed the death of the youth, but denied that police were responsible, saying that he had checked all of their vehicles and found no traces of blood, according to the state news agency. "If there was the death of a man, then maybe we should talk about an accident, and we have opened an investigation," Sy said.
In the northern town of Podor on Monday, two other civilians were killed including a woman in her sixties after paramilitary police opened fire with live rounds.

PARACHINAR, Pakistan — Government officials say Pakistani fighter jets bombed militant positions in two different areas along the Afghan border, killing 31 suspected insurgents.
Political administrators Wajid Khan and Ameer Gul say the strikes occurred Wednesday morning in the Orakzai and Kurram tribal areas.
It was not possible to independently confirm the information because the areas are effectively off-limits to reporters.
The strikes followed clashes between soldiers and militants over a strategic mountaintop in Kurram that killed over 60 people in the last week.
The Pakistani military has launched a series of offensives against militants in the country’s semiautonomous tribal region in the past few years.

Russia has clashed with Western powers and the Arab League over their demand that the United Nations take immediate action to stop Syrian President Bashar al-Assad's "killing machine."
The wrangling at the United Nations Tuesday came as fighting sharply escalated between Assad's security forces and rebels, with activists saying more than 5,400 people have died in a 10-month-old uprising.
US Secretary of State Hillary Clinton, backed by her French and British counterparts as well as Qatar's prime minister, led the charge for a tough UN resolution that would call on Assad to end the bloodshed and hand over power.
"We all know that change is coming to Syria. Despite its ruthless tactics, the Assad regime's reign of terror will end," Clinton told the UN Security Council.
"The question for us is: how many more innocent civilians will die before this country is able to move forward?"
Qatari Prime Minister Sheikh Hamad bin Jassim Al-Thani, speaking on behalf of the Arab League, said Assad's regime had "failed to make any sincere effort" to end the crisis and believed the only solution was "to kill its own people."
"Bloodshed continued and the killing machine is still at work," he said.
But Russia, a longstanding ally of Assad and one of the regime's top suppliers of weapons, declared that the UN body did not have the authority to impose such a resolution. China voiced support for Russia's position.
Moscow's ambassador to the UN, Vitaly Churkin, argued that Syria should "be able to decide for itself" and said the Council "cannot impose the parameters for an internal settlement. It simply does not have the mandate to do so."
However, the tone of the debate was measured and Churkin said that the latest version of the resolution "gives rise for hope."
"We hope that the Council will come to consensus on the Syrian issue, as is not only possible but also necessary," he said.
Speaking to reporters later, he also hinted at compromise, saying: "I think that we can produce a text which would be useful in a way which would help the Arab League to play its key role."
France also held out the possibility of a successful UN resolution and said that diplomats would pursue talks.
"From what I've heard, I take away that this is not completely impossible and that there is a chance of bringing the viewpoints together," Foreign Minister Alain Juppe said.
The key sticking point appeared to be the Arab League call for Assad's speedy departure.
"Regime change is not our profession," Russian Foreign Minister Sergei Lavrov said during a trip to Australia.
US officials said that Clinton tried unsuccessfully for two days to speak to Lavrov. Clinton dismissed suggestions that Lavrov snubbed her, saying that it was difficult to reach him in distant Australia.
The draft resolution, which was introduced by Arab League member Morocco, calls for the formation of a unity government leading to "transparent and free elections."
It stresses that there will be no foreign military intervention in Syria as there was in Libya, helping to topple Moamer Kadhafi.
In Washington, US intelligence chief James Clapper said the fall of the Assad regime was in any case inevitable.
"I do not see how he can sustain his rule of Syria," Clapper told senators. "I personally believe it's a question of time but that's the issue, it could be a long time."
Syria remained defiant, with UN ambassador Bashar Jaafari saying his country would "stand firm in confronting its enemies."
He accused the Western-Arab alliance of "double standards" and of "fomenting the crisis."
The opposition Syrian National Council meanwhile deplored the international community's lack of "swift action" to protect civilians "by all necessary means," in a statement on Facebook.
On Monday alone, almost 100 people, including 55 civilians, were killed during a regime assault on the flashpoint city of Homs, said the Syrian Observatory for Human Rights.
On Tuesday, at least 22 people were killed, all but one of them civilians, the Observatory said.
The rebel Free Syrian Army said half of the country was now effectively a no-go zone for the security forces.
"Fifty percent of Syrian territory is no longer under the control of the regime," its Turkey-based commander Colonel Riyadh al-Asaad told AFP.
He said the morale of government troops was extremely low. "That's why they are bombing indiscriminately, killing men, women and children," he said.
CIA director David Petraeus told senators in Washington that Assad now faced challenges in Damascus and Aleppo, two cities that had been seen as insulated from the unrest.
"I think it has shown indeed how substantial the opposition to the regime is and how it is in fact growing and how increasing areas are becoming beyond the reach of the regime security forces," Petraeus said.

The supposed ‘consensus’ on man-made global warming is facing an inconvenient challenge after the release of new temperature data showing the planet has not warmed for the past 15 years.
The figures suggest that we could even be heading for a mini ice age to rival the 70-year temperature drop that saw frost fairs held on the Thames in the 17th Century.
Based on readings from more than 30,000 measuring stations, the data was issued last week without fanfare by the Met Office and the University of East Anglia Climatic Research Unit. It confirms that the rising trend in world temperatures ended in 1997.
Meanwhile, leading climate scientists yesterday told The Mail on Sunday that, after emitting unusually high levels of energy throughout the 20th Century, the sun is now heading towards a ‘grand minimum’ in its output, threatening cold summers, bitter winters and a shortening of the season available for growing food.
Solar output goes through 11-year cycles, with high numbers of sunspots seen at their peak.
We are now at what should be the peak of what scientists call ‘Cycle 24’ – which is why last week’s solar storm resulted in sightings of the aurora borealis further south than usual. But sunspot numbers are running at less than half those seen during cycle peaks in the 20th Century.
Analysis by experts at NASA and the University of Arizona – derived from magnetic-field measurements 120,000 miles beneath the sun’s surface – suggest that Cycle 25, whose peak is due in 2022, will be a great deal weaker still.
According to a paper issued last week by the Met Office, there is a 92 per cent chance that both Cycle 25 and those taking place in the following decades will be as weak as, or weaker than, the ‘Dalton minimum’ of 1790 to 1830. In this period, named after the meteorologist John Dalton, average temperatures in parts of Europe fell by 2C.
However, it is also possible that the new solar energy slump could be as deep as the ‘Maunder minimum’ (after astronomer Edward Maunder), between 1645 and 1715 in the coldest part of the ‘Little Ice Age’ when, as well as the Thames frost fairs, the canals of Holland froze solid.
Yet, in its paper, the Met Office claimed that the consequences now would be negligible – because the impact of the sun on climate is far less than man-made carbon dioxide. Although the sun’s output is likely to decrease until 2100, ‘This would only cause a reduction in global temperatures of 0.08C.’ Peter Stott, one of the authors, said: ‘Our findings suggest a reduction of solar activity to levels not seen in hundreds of years would be insufficient to offset the dominant influence of greenhouse gases.’
These findings are fiercely disputed by other solar experts.
‘World temperatures may end up a lot cooler than now for 50 years or more,’ said Henrik Svensmark, director of the Center for Sun-Climate Research at Denmark’s National Space Institute. ‘It will take a long battle to convince some climate scientists that the sun is important. It may well be that the sun is going to demonstrate this on its own, without the need for their help.’
He pointed out that, in claiming the effect of the solar minimum would be small, the Met Office was relying on the same computer models that are being undermined by the current pause in global-warming.
CO2 levels have continued to rise without interruption and, in 2007, the Met Office claimed that global warming was about to ‘come roaring back’. It said that between 2004 and 2014 there would be an overall increase of 0.3C. In 2009, it predicted that at least three of the years 2009 to 2014 would break the previous temperature record set in 1998.
So far there is no sign of any of this happening. But yesterday a Met Office spokesman insisted its models were still valid.
‘The ten-year projection remains groundbreaking science. The period for the original projection is not over yet,’ he said.
Dr Nicola Scafetta, of Duke University in North Carolina, is the author of several papers that argue the Met Office climate models show there should have been ‘steady warming from 2000 until now’.
‘If temperatures continue to stay flat or start to cool again, the divergence between the models and recorded data will eventually become so great that the whole scientific community will question the current theories,’ he said.
He believes that as the Met Office model attaches much greater significance to CO2 than to the sun, it was bound to conclude that there would not be cooling. ‘The real issue is whether the model itself is accurate,’ Dr Scafetta said. Meanwhile, one of America’s most eminent climate experts, Professor Judith Curry of the Georgia Institute of Technology, said she found the Met Office’s confident prediction of a ‘negligible’ impact difficult to understand.
‘The responsible thing to do would be to accept the fact that the models may have severe shortcomings when it comes to the influence of the sun,’ said Professor Curry. As for the warming pause, she said that many scientists ‘are not surprised’.
She argued it is becoming evident that factors other than CO2 play an important role in rising or falling warmth, such as the 60-year water temperature cycles in the Pacific and Atlantic oceans.
‘They have insufficiently been appreciated in terms of global climate,’ said Prof Curry. When both oceans were cold in the past, such as from 1940 to 1970, the climate cooled. The Pacific cycle ‘flipped’ back from warm to cold mode in 2008 and the Atlantic is also thought likely to flip in the next few years .
Pal Brekke, senior adviser at the Norwegian Space Centre, said some scientists found the importance of water cycles difficult to accept, because doing so means admitting that the oceans – not CO2 – caused much of the global warming between 1970 and 1997.
The same goes for the impact of the sun – which was highly active for much of the 20th Century.
‘Nature is about to carry out a very interesting experiment,’ he said. ‘Ten or 15 years from now, we will be able to determine much better whether the warming of the late 20th Century really was caused by man-made CO2, or by natural variability.’
Meanwhile, since the end of last year, world temperatures have fallen by more than half a degree, as the cold ‘La Nina’ effect has re-emerged in the South Pacific.
‘We’re now well into the second decade of the pause,’ said Benny Peiser, director of the Global Warming Policy Foundation. ‘If we don’t see convincing evidence of global warming by 2015, it will start to become clear whether the models are bunk. And, if they are, the implications for some scientists could be very serious.’

Brazil's state-run energy giant Petrobras on Tuesday reported that 160 barrels of crude oil may have spilled from a deep-water well off Sao Paulo state but said the situation was under control.
A company statement said a production string rupture of the FPWSO Dynamic Producer (vessel platform) was detected early Tuesday, roughly 300 kilometers (180 miles) off the coast of Sao Paulo state, where water depth reaches 2,140 meters (6,600 feet).
It said the well was automatically shut down after the rupture by the safety system and has been secured.
"A preliminary estimate indicates that 160 barrels of oil may have spilled. There is no possibility of the oil reaching the Brazilian coast," Petrobras said.
It added that an investigation was launched to determine the cause of the leak.
Petrobras said it notified the Brazilian Navy, the Brazilian Institute of Environment and Renewable Natural Resources (IBAMA) and the Brazilian National Petroleum Agency (ANP).
It was the second oil spill in Brazil in less than a week.
Last Thursday, Transpetro, a Petrobras subsidiary, said it had detected a spill off the coast of Rio Grande do Sul state but did not know how much had spilled.
Petrobras's transportation unit said it was not possible to estimate how much oil had leaked but said personnel and equipment were deployed to contain and remove the spill off the coast of the southern state.
In November, another oil spill was detected in a well operated by US energy company Chevron near the Frade field, 370 kilometers (231 miles) northeast of the Rio de Janeiro coast.
The spill was eventually contained and Chevron was subject to several environmental fines.
The case was a wake-up call for Brazil as it prepares to tap huge underwater oil fields, which ANP says hold reserves that could surpass 100 billion barrels of high-quality recoverable crude.
These fields are off Brazil's southeast Atlantic coast beneath kilometers of ocean, bedrock, and hot salt-beds.
In 2010, Petrobras was the world's third biggest oil producer in terms of market value at $228 billion. By late last month it had fallen to 5th place, with its value down to $156 billion, according to the daily newspaper O Globo.
India Joins China in Defying Sanctions; Won't Cut Iran Oil Imports

MUMBAI, India — India has joined China in saying it will not cut back on oil imports from Iran, despite stiff new U.S. and European sanctions designed to pressure Tehran over its nuclear program.
"It is not possible for India to take any decision to reduce the import from Iran drastically because, after all, the countries which can provide the requirement of the emerging economy, Iran is an important country among them," India's finance minister Pranab Mukherjee told reporters Sunday in Chicago.
India and China together accounted for 34 percent of Iran's oil exports from January to September of 2011 — slightly more than Europe, according to International Energy Agency data.
The move is likely to be seen as a political victory in Iran, but it's unclear how Chinese and Indian companies will actually be able to pay for Iranian oil without running afoul of the sanctions, analysts said.
"It's a blow," said David Hartwell, senior Middle East analyst at IHS Jane's, adding that Iran may have discounted prices to keep the Chinese and Indians on their side. "If you have two major countries like India and China saying they will not abide by the sanctions, that's going to keep a vital line open for the Iranians to continue to sidestep the sanctions and get foreign capital."
He said India and China could just be trying to buy time to diversify their oil supplies and may steer away from Iran, especially if Saudi Arabia — India's largest source of oil imports — were to ramp up production and offer an attractively priced alternative.
The European Union last week imposed an oil embargo against Iran and froze the assets of its central bank. In December, the U.S. said it would bar financial institutions from the U.S. market if they do business with Iran's central bank.
India and China are ravenous energy consumers and rely heavily on imported oil. Iranian oil accounts for 9 percent of India's oil consumption and 6 percent of China's, according to the latest data from the IEA.
Iran exports 2.5 million barrels of oil per day, about 3 percent of world supplies. About 500,000 barrels go to Europe and most of the rest goes to China, India, Japan and South Korea. [Do you read the U.S.A. importing oil from Iran? No. (emphasis mine)]
China has called for negotiations over Iran's nuclear program. South Korea has been noncommittal about the sanctions, and Japan is seeking an exemption, saying its Iranian oil imports have steadily declined and probably will continue to do so.
Kyodo News agency reported that senior Japanese and U.S. officials on Thursday will hold their second meeting on the sanctions this month.
"I believe it may not be easy to come to a conclusion on this matter in the upcoming discussions," Foreign Minister Koichiro Gemba said.
Western sanctions could make it harder for India to pay for the oil it gets from Iran. Past sanctions have already delayed payments by Indian oil importers, who have had to scramble to find banks willing to handle transactions with Iran.
India's central bank governor D. Subbarao said last week that the current payment mechanism was "working fine," though India was also "exploring other options," which he declined to discuss.
Indian companies now reportedly route payments through Turkey's Turkiye Halk Bankasi AS, after EU pressure forced German-based Europaisch-Iranische Handelsbank AG to stop handling the payments last year.
IHS Jane's energy analyst Catherine Hunter said Turkey is unlikely to shut down that route immediately, noting that Turkish oil refiner Tupras also uses this payment mechanism.
"But this route remains susceptible to external pressure," she added by email. "India is now discussing rupee based payments and direct trade — however that has a number of drawbacks for Iran given the trade imbalance and restrictions on use. China isn't publicly discussing options but I imagine other currency payments are also on the cards there."
The U.S. and its allies believe Iran is using oil revenues to develop nuclear weapons, but Tehran insists its nuclear program is purely for peaceful purposes.
Iran Sanctions Won’t Work... Effectiveness Of Economic Restrictions Always Erodes Over Time

As the United States and its allies ratchet up economic sanctions against Iran in an effort to get the regime to abandon its nuclear program, it’s important to remember that such sanctions rarely work. It is doubtful that increased sanctions against Iran will work any better.
The United States already prohibits most transactions between U.S. and Iranian financial institutions, imposes penalties on companies that provide assistance to the Iranian petroleum industry and prohibits most trade with Iran, including the import of Iranian products, such as rugs, caviar and pistachio nuts.
Fearing that Iran is getting ever closer to producing a nuclear weapon, many U.S. and European policymakers want to tighten the sanctions - by cutting off Iranian oil exports, for example - even if this leads to higher oil prices.
For the United States, which already imports no petroleum from Iran, the new sanctions are intended to impair the ability of other countries to buy Iranian oil. This would be accomplished by imposing sanctions on entities from those nations that complete transactions with Iran's central bank, which provides the payment mechanism for oil purchases.
While supporters of the tightened sanctions see the measure putting additional economic pressure on the Iranian government, Iran’s long-term revenue losses from oil exports probably would be minimal. For example, despite the existing sanctions on Iran’s petroleum sector, the country exported some $71.6 billion worth of petroleum products in 2010, according to the Organization of Petroleum Exporting Countries (OPEC). The Iranian government reports that 2011 was even better - calling it a record year of oil sales.
The problem with all sanctions is that they erode over time as the target nation redirects its products to countries that aren’t participating in the sanctions or finds ways to trade illegally with entities in the sanctioning countries. With such market “reordering” and outright evasion, the target country is rarely starved of export revenues.
Sanctions on Iranian oil, for example, are bound to fail because rapidly growing countries in the developing world, such as China and India, care less about Iran’s nuclear program than about getting cheap oil. Iran probably will oblige them by selling its oil at a discount, thus allowing it to recoup otherwise lost sales. More important than the likely economic effects of the sanctions are the likely political effects. Yet sanctions are fundamentally an economic tool for achieving political ends.
The purpose of sanctions is not just to ratchet up economic pressure for its own sake but to achieve some stated political objective. Yet the history of sanctions shows they not only typically fail to achieve their economic objectives but also rarely achieve their political goals, such as getting a country to abandon its nuclear program or causing a regime to fall.
Consider North Korea and Iraq. Despite harsh international economic sanctions, North Korea probably has created several nuclear weapons. In Iraq, the most universal and biting economic sanctions in world history could not induce Saddam Hussein to withdraw his invasion forces from Kuwait in the early 1990s.
The Iranian nuclear program appears to have widespread public support across the Iranian political spectrum because it is seen as an issue of national prestige. Also, Iran has hostile neighbors such as Israel, which likely has hundreds of nuclear weapons, and Saudi Arabia, which may have a secret nuclear program. So the Iranian government is not likely to abandon its nuclear program.
In fact, the Iranian government - weakened by the fraudulent elections of 2009 - is using the specter of economic hardship resulting from externally imposed sanctions to rally public support.
Thus, the harsher sanctions, even in the improbable event that they could put significant long-term economic pressure on Iran’s economic linchpin and main source of external revenue - oil exports - are unlikely to achieve the ambitious political goals of ending Iran’s nuclear program or bringing about “regime change.”
If anything, the sanctions are likely to increase support for the regime as Iranians, like other people in similar circumstances of external pressure, rally around their flag.

Most of the soaring $1 trillion federal deficit is the blame of President Obama's spending and political deals according to a pro-Obama think tank that pegged former President George W. Bush's responsibility at just 35 percent.
While opening its analysis by blaming Bush and showing pictures of Senate GOP leaders, the Center for American Progress said that the other 65 percent of the deficit surge came on Obama's watch, a combination of high spending, extension of the Bush tax cuts and additional defense spending.
"The analysis reveals that events that occurred before January 2009, including the onset of the Great Recession and increased spending—especially on the wars in Afghanistan and Iraq—attributed to 35 percent of the swing from surplus to deficit," said the center founded by long-time Obama advisor John Podesta.
"The remainder of the deterioration did happen after 2009, but mostly because of lower-than-expected revenues. While some of the decline in revenue resulted from the continued economic weakness, the majority of it, about $335 billion, is the direct result of the tax deal signed into law in December 2010, which extended all of the Bush tax cuts," said the group.
While he was pushing the tax deal that December, Obama said that the cuts for middle-class Americans were being held hostage by GOP demands that reductions for high-earners be kept in, though he convinced his Democrats to OK the compromise by calling it a "good deal for the American people."
Still, CAP says the deficit is Bush's fault because of his tax cuts. The group, well-known for its authoritative reports, said that "together, events that occurred before January 2009 and the decline in tax revenues account for about 83 percent of the difference between what the 2012 deficit actually is and what it was expected to be five years ago."
No matter who is to blame, the deficit is unhealthy. The Feds in 2007 had predicted that the nation would enjoy a $170 billion surplus today, but then the bank crisis hit, the wars continued and Obama passed bailout and stimulus plans which he says saved the nation from a second Great Depression.
The author of the report, Michael Linden, explains that tax cuts are starving the nation.
"Tax cuts are far more to blame for our current deficit than any increases in spending,” he said. “And if we continue to pile up tax cuts on top of tax cuts, it will have the same effect in the coming decade as it did in the last one: huge deficits and a growing debt.”
In defending Obama, he added, "The narrative that an 'Obama spending spree' caused our deficit problem is utterly false."

California has a huge state debt and Washington has a huge national debt. But that does not discourage either Governor Jerry Brown or President Barack Obama from wanting to launch a very costly high-speed rail system.
Most of us might be a little skittish about spending money if we were teetering on the brink of bankruptcy. But the beauty of politics is that it is all other people's money, including among those other people generations yet unborn.
The high-speed rail system proposed for California has been envisioned as a model for similar systems elsewhere in the United States. A recent story in the San Francisco Chronicle used the high-speed rail system in Spain as an analogy for California.
Spain is about the same size as California, and has a similar population density — and population density is the key to the economic viability of mass transportation, from subways to high-speed rail.
It so happens that I have ridden on Spain's high-speed rail system. It was very nice, especially since I did not have to pay the full costs, which were subsidized by the Spanish taxpayers.
While the Spanish government has been subsidizing the passengers on its high-speed rail system, the European Union has been subsidizing the Spanish government. Someone once said that government is the illusion that we can all live off somebody else. Spain's high-speed rail system is not even covering its operating costs, never mind the enormous costs of setting up the system in the first place. One reason is that half the seats are empty in the high-speed trains in Spain.
That is what happens when you don't have the population density required for passengers to cover the operating costs. You would need the hordes of Genghis Khan riding the high-speed rail system to cover the additional costs of the rails and the trains.
An economics professor at the University of Barcelona says that Spain "has not recovered one single euro from the infrastructure investment."
The most famous high-speed rail system is that in Japan, one of the most densely populated countries in the world.
The "bullet train" between Tokyo and Osaka has 130 million riders a year. Tokyo alone has more than three times the population of San Francisco and Los Angeles put together.
In California, an element of farce has been added to the impending economic tragedy, if the envisioned high-speed rail system actually materializes.
The first leg of the system is planned to run between Fresno and Bakersfield. If those names don't ring a bell with you, there is a reason. They are modest-sized communities out in the agricultural San Joaquin Valley, well removed from San Francisco or Los Angeles.
You can bet the rent money that high-speed rail traffic between Fresno and Bakersfield will never come within shouting distance of covering the operating costs. Some people have analogized putting such a rail line between these two towns to the infamous "bridge to nowhere" in Alaska.
Why are they doing it? Because they can.
If they began this project where they want it to go — between San Francisco and Los Angeles — they would run into so much opposition from the environmentalists, and from local politicians influenced by the environmentalists, that the delays could take the high-speed rail advocates beyond the time limit for using the federal subsidy money. But the green fanatics have not yet taken over politically out in the San Joaquin Valley.
The only reason for even thinking about building a high-speed rail line between Fresno and Bakersfield is just to get the project underway with federal money, making it politically more difficult to stop the larger project for a similar rail line between San Francisco and Los Angeles.
In other words, they are going to start wasting money out in the valley, so that they will be able to waste more money later on, along the coast. This may not make any sense economically, but it can make sense politically for Jerry Brown and Barack Obama.
An old song ended, "You've been running around in circles, getting nowhere — getting nowhere very fast." On high-speed rail.

CONFIRMATION: Gov. Brown Seeking to REPEAL provisions of CA's Hayden Law
YES, Governor Brown WILL be seeking repeal of those provisions of Hayden found to be "reimbursable state mandates." I just got off the phone with Jeff Carosone, the analyst in the Dept. of Finance assigned to this portion of the Governor's proposed budget.
Brown is definitely seeking to repeal ALL of the provisions of Hayden that the Commission on Mandates ruled to be “reimbursable state mandates,” so Carasone referred me to the 2001 Statement of Decision (http://www.csm.ca.gov/sodscan/98tc11sod.pdf) and the 2006 Adoption of Parameters and Guidelines (http://www.csm.ca.gov/sodscan/203.pdf).
The provisions subject to repeal will be:
Providing care and maintenance during the increased holding period for impounded dogs and cats that are ultimately euthanized. The increased holding period shall be measured by calculating the difference between three days from the day of capture and four business days from the day after impoundment, as specified below in 3 (a) and 3 (b), or six business days from the day after impoundment (Food & Agr. Code, §§ 31108, 31752);
Providing care and maintenance for four business days from the day after impoundment, as specified below in 3 (a) and 3 (b), or six business days from the day after impoundment, for impounded rabbits, guinea pigs, hamsters, pot-bellied pigs, birds, lizards, snakes, turtles, or tortoises legally allowed as personal property that are ultimately euthanized (Food & Agr. Code, § 31753);
For dogs, cats, and other specified animals held for four business days after the day of impoundment, either: (a) Making the animal available for owner redemption on one weekday evening until at least 7:00 p.m., or one weekend day; or (b) For those local agencies with fewer than three full-time employees or that are not open during all regular weekday business hours, establishing a procedure to enable owners to reclaim their animals by appointment at a mutually agreeable time when the agency would otherwise be closed (Food & Agr., Code §§ 31108, 31752, and 31753);
Verifying whether a cat is feral or tame by using a standardized protocol (Food & Agr. Code, § 31752.5);
Posting lost and found lists (Food & Agr. Code, § 32001);
Maintaining records on animals that are not medically treated by a veterinarian, but are either taken up, euthanized after the holding period, or impounded (Food & Agr. Code, § 32003);
and Providing "necessary and prompt veterinary care" abandoned animals other than injured cats dogs given emergency treatment that are ultimately euthanized.
TAKE ACTION: Contact Governor Jerry Brown, and tell him you OPPOSE the repeal of any portion of Hayden. At a time when other states in the U.S. are enacting legislation to advance the protection of animals in shelters, California should not be stepping backwards. Contrary to the assertion of HSUS' Jennifer Fearing, the paradigm has NOT shifted in California's shelters and animals continue to be killed at rates that far outpace the rates of adoption. [ETA: Jennifer Fearing has informed me that the statements attributed to her in the original Sacramento Bee article are inaccurate and that HSUS will be lobbying against the repeal of Hayden.] The public policy preference of California continues to be favoring life over death, and thus the adoption, rather than killing, of shelter animals.

Boldness is what God wants you to have when you come to Him. He does not want you to be afraid to come to Him, feeling unworthy because of your sins. He wants you to come boldly to Him, knowing that the death, burial and resurrection of His Son Jesus Christ has justified you and qualified you to boldly receive from Him.
This was the kind of boldness that the woman with the issue of blood had when she touched Jesus. (Mark 5:25–34) Now, by touching Jesus, she knew that she was breaking a Levitical law which states that anyone with a bodily discharge is unclean, and should not appear in public, let alone touch another person. (Leviticus 15)
But she refused to feel condemned by the law. She believed what she had heard about Jesus, and was confident that there would only be love and compassion, not condemnation, from Him. She believed that Jesus would justify her and qualify her to receive the miracle she needed. That was why she boldly pressed her way into the crowd to touch Jesus, who indeed said to her, “Daughter, your faith has made you well.” (Mark 5:34)
What was it about her faith that made her well? Romans 4:5 talks about faith that believes God justifies the ungodly. When you believe that God justifies the ungodly, it will give you boldness to come to God, even when you feel unclean because you have just blown it.
When you fail, don’t run away from God. Run boldly to Him, knowing that you are justified by the blood of Christ and not by your good behavior.
The devil may say to you, “How can you do that? Who do you think you are?” Don’t listen to him. Pick yourself up and thank God for the blood and the gift of no condemnation. (Romans 8:1) If God justifies the ungodly, how much more you, His beloved child!

A powerful solar eruption is expected to blast a stream of charged particles toward Earth tomorrow (Jan. 24), as the strongest radiation storm since 2005 rages on the sun.
Early this morning (0359 GMT Jan. 23, which corresponds to late Sunday, Jan. 22 at 10:59 p.m. EST), NASA's Solar Dynamics Observatory caught an extreme ultraviolet flash from a huge eruption on the sun , according to the skywatching website Spaceweather.com.

A wave of charged particles from an intense solar storm is pummeling the Earth right now, which may trigger stunning aurora displays and cause minor disruptions to satellites over the next two days, NASA scientists say.
The storm began when a powerful solar flare erupted on the sun yesterday (Jan. 23), blasting a stream of charged particles toward Earth. This electromagnetic burst, called a coronal mass ejection (CME), hit Earth at about 9:31 a.m. EST (1430 GMT), according to scientists at the Space Weather Center at NASA's Goddard Space Flight Center in Greenbelt, Md.
"It's a minor to moderate storm," Yihua Zheng, a lead researcher at the Space Weather Center, told SPACE.com. "Probably in the next 10 hours or so, people at high latitudes can see auroras. This could maybe cause communication errors at the polar caps, but the magnetic activities are probably not too strong."

A massive solar flare — the strongest one so far this year — erupted today (Jan. 27) from the same active region of the sun that triggered a raging solar tempest earlier this week.
The solar flare was rated an X1.7-class eruption, according to the National Oceanic and Atmospheric Administration (NOAA). X-class flares are the most powerful type of solar storm, with M-class storms falling within the mid-range, and C-class flares being the weakest.
Several spacecraft, including NASA's Solar Dynamics Observatory and the Solar Heliospheric Observatory, observed the solar eruption, which occurred at 1:37 p.m. EST (1837 GMT). The flare unleashed a wave of charged particles, called a coronal mass ejection, but space weather experts said it was not aimed at Earth.

Being the creative person you are, I’m pretty sure that at any one time you have probably a few hundred thoughts zipping around your mind, all vying for your attention.
They range from the trivial every day thoughts like “What shall we have for dinner tonight?” and “When is our car due a service?” to deeper concerns like “Is this dull pain in my stomach anything to be concerned about?” and “Will I ever be as creative as I was in my early 20s again?”.
Along with just about everything in between.
It’s ironic that although we’re capable of being highly creative and have a constant source of ideas pouring forth in our minds, the flip side is this equally infinite onslaught of thoughts and worries, all capable of distracting us, and at times it seems completely debilitating us from creating anything at all.
Then there’s that whole OTHER layer of worries about worrying, and analysis of analysing.
“If only I didn’t worry so much I could just get on and enjoy my life and what I want to create. I worry I worry too much, then that makes me worry even more! What’s wrong with me, I think I need to figure this out, think it through thoroughly, before I get to creating anything…”
Sound familiar?
I know as I was writing that last paragraph my own mind was saying: “Hey, that’s my line, did I give you permission to say it loud in public?”
What if we could just stop all the worries, thoughts and concerns? What if there was a switch that just stopped them all in an instant so we could get on and focus on creating what’s important to us, what we’re passionate about?
What if we could put them all in a huge box, chain it shut, put it in a dark corner down in the basement, lock the door and never see it again?
Well, that’s not going to happen. There’s no magic trick, no secret method to removing all those thoughts from your head. Not one that doesn’t involve invasive brain surgery at least.
But you know what? This is a GOOD thing!
Because as we said just now, all this thinking – all this endless activity in your mind – is the flip side of being creative and being able to pour out ideas like a barman pours out beers on a Saturday night in the busiest bar in town.
You know I said there wasn’t a trick or a secret to switching all your thoughts and worries off? Well, that is true, but there IS a way to deal with them far more easily, to all but eliminate their impact on hindering your creativity.
You can’t turn them off, but you can turn them down, and you can tune them out.
Imagine your mind as a radio, where you can tune into thousands of different channels. Whilst all these channels are still broadcasting a signal 24 hours a day, you can choose which channels you listen to, which you tune into.
So if you don’t want to listen to that annoying high pitched host of W.O.R.R.Y FM, then you don’t have to.
Actually imagine in your mind how this DJ sounds, endlessly rambling on with their fears and concerns. Then tune them out, turn them down. See them disappearing in your mind. Instead of being on full volume at the front of your thoughts, picture them fading away into grainy black and white and receding into the distance.
See them drifting away, become ever quieter and more transparent, their image and voice breaking up and fading like a ghost disappearing as day breaks. Imagine them just drifting into a single collected mass of your thoughts, a gentle low background presence that doesn’t concern you.
You know like when your in a building in a city and you can hear the traffic outside? You know it’s there, and if your bring your attention to it, you hear the rush by of every car, truck and bike. But most of the time it is just a background presence. You don’t need to listen, it’s just there, not doing any harm, whilst you get on with what you need to get on with.
Practice tuning out your own inner radio channels that have up until now distracted you.
Give them names, imagine the host’s face, give them a personality, rather than have them as an ominous floating fearful entity.
Then tune them our, watch them fade away into the soft background melee of sound you don’t need to focus on or pay any attention to.
The more you do this, the easier it will become.
In the meantime, just create.
Give yourself specific dates and times, mark it in your calendar, a short block of time each day. You only need 10 or 15 minutes to begin.
Building this daily creative habit, making full use of the time rather than endlessly worrying will make a huge change in your creative life.
You can start today, and I’m confident you will. Because we need to create, it’s not an option. It’s what we do. It’s what we must do.

To think that "I am the mind," is unawareness. To know that mind is only a mechanism just as the body is, to know that the mind is separate.... The night comes, the morning comes: you don't get identified with the night. You don't say, "I am night," you don't say, "I am morning." The night comes, the morning comes, the day comes, again the night comes; the wheel goes on moving, but you remain alert that you are not these things.
The same is the case with the mind. Anger comes, but you forget -- you become anger. Greed comes, you forget -- you become greed. Hate comes, you forget -- you become hate. This is unawareness.
Awareness is watching that the mind is full of greed, full of anger, full of hate or full of lust, but you are simply a watcher. Then you can see greed arising, becoming a great, dark cloud, then dispersing -- and you remain untouched. How long can it remain? Your anger is momentary, your greed is momentary, your lust is momentary. Just watch a little and you will be surprised: it comes and it goes. And you are remaining there unaffected, cool, calm.
The most basic thing to remember is that when you are feeling good, in a mood of ecstasy, don't start thinking that it is going to be your permanent state. Live the moment as joyfully, as cheerfully as possible, knowing perfectly well that it has come and it will go -- just like a breeze comes in your house, with all its fragrance and freshness, and goes out from the other door.
This is the most fundamental thing. If you start thinking in terms of making your ecstatic moments permanent, you have already started destroying them. When they come, be grateful; when they leave, be thankful to existence (God). Remain open. It will happen many times -- don't be judgmental, don't be a chooser. Remain choiceless. Yes, there will be moments when you will be miserable. So what? There are people who are miserable and who have not even known a single moment of ecstasy; you are fortunate. Even in your misery, remember that it is not going to be permanent; it will also pass away, so don't get too much disturbed by it. Remain at ease.
Just like day and night, there are moments of joy and there are moments of sadness; accept them as part of the duality of nature, as the very way things are. And you are simply a watcher: neither you become happiness nor you become misery. Happiness comes and goes, misery comes and goes. One thing remains always there -- always and always -- and that is the watcher, one who witnesses.
Slowly, slowly get more and more centered into the watcher. Days will come and nights will come... lives will come and deaths will come... success will come, failure will come. But if you are centered in the watcher -- because that is the only reality in you -- everything is a passing phenomenon.
Just for a moment, try to feel what I am saying: just be a watcher....
Do not cling to any moment because it is beautiful, and do not push any moment because it is miserable. Stop doing that. That you have been doing for lives. You have not been successful yet and you will never be successful ever. The only way to go beyond, to remain beyond, is to find a place from where you can watch all these changing phenomena without getting identified.
Everything passes, but you remain. You are the reality; everything else is just a dream. Beautiful dreams are there, nightmares are there... But it does not matter whether it is a beautiful dream or a nightmare; what matters is the one who is seeing the dream. That seer is the only reality.

This is one of my all time favorite movies! It was just the OOMPH that I needed to kick it into HIGH gear! This movie has very many spiritual principles that are key to our conscious elevation. It also portrays the ongoing battle between LIGHT and darkness! Know this, the dark forces will not win. LIGHT WILL PREVAIL. I have posted the last half hour of this movie! However, I highly recommend that you watch this movie from the beginning so that you better understand what led up to this moment. It still blows my mind when I watch it. Let this movie inspire you to do the following:
