MOBILE, Ala. (WALA) - A Mobile pastor found guilty on several charges involving sexual misconduct was sentenced this week.

Bradrick Vail, the pastor of “Tree of Life Deliverance Ministry” was originally charged with three counts of rape, sexual abuse, and sodomy.

He was later found guilty on seven counts of sexual misconduct.

A circuit court judge dismissed five of those seven charges, sentencing Vail to one year in jail for each count.

Vail was accused of sexually assaulting two of his former church members.

On Monday, emotional testimony was heard from one of the alleged victims and Vail.

Vail’s defense attorney David Allen says they plan to appeal.

“Yeah obviously we’re disappointed but we were pleased that Judge Phillips did vacate five of the seven convictions,” Allen said. “He has been convicted of two misdemeanors and he was sentenced to one year consecutive with another year so two years. Like Judge Phillips indicated he is entitled to an appeal bond. So as soon as he makes his appeal bond he can get out.”

Judge Phillips set his appeal bond at $5,000.

If he makes bond he’s ordered to have no contact with either alleged victim.

Allen says he’s not aware if Vail is still pastoring within Mobile County.

MOBILE, Ala. (WALA) - A pastor facing multiple Class A felonies received a significantly lighter judgment from a jury Thursday, but even most of the misdemeanor offenses he was convicted of now are in jeopardy.

The Mobile County Circuit Court jury deliberated over parts of two days before returning the verdict against Bradrick Markeice Vail Sr., who was pastor of Tree of Life Deliverance Ministry on Stanton Road. He had been charged with three counts of first-degree rape, one count of first-degree sodomy and three counts of first-degree sexual abuse. But the jury opted to convict the 36-year-old Theodore man on seven counts of misdemeanor sexual misconduct charges.

Defense attorney David Allen said he believes five of those seven counts should be dismissed because the conduct was outside the one-year time limit for misdemeanor crimes.

“Ultimately, he walked in looking at life in prison, and he walked out with seven misdemeanors, five of which very likely will be vacated,” he told FOX10 News.

A spokeswoman for the Mobile County District Attorney’s Office told FOX10 News that prosecutors are aware that there could be a legal issue with those counts. Nonetheless, Mobile County Chief Assistant District Attorney Jennifer Susman said Vail will end up with a criminal record.

“The defendant is now convicted of a registerable offense, and it will be known by anyone in the future who chooses to hire him when they do a background check,” she said. “This was an incredibly important and brave thing for these victims to do, and I applaud them. Regardless of the outcome, they said their peace and they were believed.”

Two women testified that he sexually assaulted them. One woman testified that a member introduced her to Vail and that she started attending the church in 2022. She told jurors that Vail, at the home of her relative, told her to get undressed and kneel on top of a Bible. She testified that he put a sheet over her and raped her.

Another woman testified that she met Vail in 2023 and that he assaulted her in a similar fashion after the defendant offered to pray for her because she was having shoulder pain.

Mobile County Circuit Judge Jill Phillips allowed Vail to remain free on bond until sentencing, which she set for April 7.
