Roger Barnett, Arizona Rancher Case Verdict

The bill AZ signed into law last week merely makes it illegal to be illegal at the state level. Isn't that redundant? The federal govt hasn't been doing their job therefore the state of AZ had to take measures to protect the citizens of their state. They have the HIGHEST rate of kidnappings and murders. If you're mother get's MURDER by an illegal immigrant gang member, that person can now be prosecuted INSTEAD OF PROTECTED.

For those of you who are upset from reading this... please put yourselves in the Arizonan's shoe's. If you lived there and you were either raped, murdered or had your property destroyed by an illegal gang member, YOU WOULD NOT BE THE VICTIM. The illegal gang member who should be looked upon as the criminal in these matters is TREATED LIKE THE VICTIM. Why? Well because of civil rights attorney's who have found ways to PROTECT THEM and claim our laws are discriminatory. Most of the time, there is NO JUSTICE for the REAL VICTIM of their crimes.

I also just want to say that this bill is not going to be like the movie, "Mi Familia" where they start rounding up every hispanic person and load them up into freight cars and send them to Guadalajara, Mexico. That's what the movement against this bill would have everybody believe.

If this were the case, you better believe I would be front and center standing up against it.

This Arizona bill mimics the Federal law WORD for WORD. Plus, this bill takes it one step further to cover their arses and specifically states that no person can be stopped and questioned or harassed due to race. In other words, racial profiling is prohibited under this new law. It honors the 4th and 14th amendment look them up if you don't know what they are. Police can't just approach somebody asking for documents, you have to be in the process of or have committed a crime for them to be able to do so. Just think about this, if the police are looking for a white bank robber isn't that racial profiling too?

The hispanic community are totally being manipulated and used right now by the "power's that be". That really pisses me off beyond belief. Those of you in positions of powers ought to be ashamed of yourselves for feeding the hispanic community such obscene misinformation and scaring the crap out of them.

Finally can talk about it. Dog tired after 2 wks of trial. Verdict I'd score as 90-95% defense win.

Court dismissed conspiracy against civil rights and some other claims. Dismissed case as to Mrs. Barnett and as to his brother Donald. Also dismissed claims by 10 of the 16 plaintiffs, who hadn't testified.

Jury verdict on remainder:

Civil rights violation: defense verdict.

Unlawful imprisonment: defense verdict.

Battery, allegedly kicking the girl: defense verdict.

Assault: defense verdict as to two, two got $1400 each (minus 25% for their own fault), two got a nominal $1.

Infliction of emotional distress: Two got $1,000 each (minus 25% for their fault) plus $10,000 punitives each, two got $7,500 each actuals (-25%) plus $20,000 each, two got a defense verdict.

We have good grounds for appeal on the two where some Ps won. But to sum up:

They lost 12 of 16 plaintiffs (10 dismissed, two defense verdicts on everything),

2 of 3 defendants,

their hope for atty fees award (which requiring winning one of the federal claims)

and got a total of under 0.5% of the $32 million they wanted,

and that's likely reversed on appeal.
